Platform Linkage & Equipment Rental Disclaimer

GearLocal Kenya operates strictly as a peer-to-peer directory and linkage platform. Please review the following terms that govern all gear sales, equipment rentals, and user interactions.

1. Pure Linkage & Classifieds Service

GearLocal Kenya (operated at gearlocal.co.ke) provides an online directory where individual equipment owners, rental businesses, and creators list camera equipment, lenses, and audiovisual production tools for sale or rent.

GearLocal is not an equipment rental agency, equipment broker, or escrow holder. GearLocal does not process rental transactions, hold damage deposits, inspect gear, or participate in handover contracts between users.

2. Direct Private Agreements Between Parties

Any rental booking, hire agreement, handover, or sale transaction concluded following contact on GearLocal is a direct private agreement solely between the equipment owner/seller and the renter/buyer.

Both parties are exclusively responsible for negotiating, setting, and enforcing their own rental terms, pricing, cancellation policies, identity verification, and security deposits.

3. Limitation of Liability & Assumption of Risk

To the fullest extent permitted by Kenyan law, GearLocal Kenya, its operators, directors, and affiliates shall not be liable for any:

  • Loss, damage, theft, or destruction of equipment before, during, or after a rental or test.
  • Failure of any party to pay agreed hire fees, deposits, or replacement charges.
  • Personal injury, accident, or property damage arising from equipment use or transport.
  • Delays, cancellations, or equipment breakdowns impacting film or photography productions.
  • Disputes, fraudulent representations, or non-return of hired equipment.

4. Security Recommendations for Equipment Owners

Verify Identity: Always inspect original Kenyan National ID or Passport and retain a verified copy before releasing high-value equipment.
Send a Gear Minder: For high-end cinema bodies (FX3, FX6, RED, Arri) and GM/Cine lenses, we strongly recommend sending a paid assistant or minder to accompany the gear on set.
Signed Handover Checklist: Test equipment together and sign a checklist recording serial numbers, cosmetic condition, and included batteries/accessories.
Equipment Insurance: Maintain comprehensive camera and production gear insurance covering third-party hire and theft.

5. Inspection Guidelines for Renters

Test Every Function: Power on cameras, test autofocus, check sensor glass for dirt or scratches, and record sample footage to your SD/CFexpress card.
Inspect Optical Glass: Shine a phone flashlight through lenses to verify absence of fungus, haze, or element separation.
Agree on Return Time: Confirm exact return times and locations in writing to avoid late fees or misunderstandings.
